The Niger State Gubernatorial election tribunal sitting in High court complex, Minna has ruled that a preliminary objection filed by the counsel to 1st respondent, Alhaji Abubakar Sani Bello, Ojemini Esq, will be heard while ruling on it is reserved until the determination of substantive.
Counsel to second respondant, Ojemini Esq has raised the issue at the pre-trial conference, while counsel to first Petitioner Umar Nasko, Mohammed Kudu Ndayako Esq raised an objection to the hearing of preliminary objection citing section 285 of 1999 constitution as amended.
The tribunal led by its chairman Hon. Justice I. Igboji agreed with submission made by Ndayako and therefore ordered the preliminary objection be heard while ruling will be made on it the same day with the ruling on substantive suit.
Speaking to Nigerwatch Newspaper, Mr. Ndayako said he was satisfied with the ruling, also counsel to second respondent Abubakar Sani Bello, said “that is the law”
It will be recalled that the tribunal had in the past granted an exparte motion moved by Mr. Ndayako seeking substituted service.
Hearing will continue on the 18th of may 2019.
